1. Agreement to Terms
By accessing or using the Construction-Time platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. Definitions
- Service — The Construction-Time platform and related features provided by Construction-Time LLC.
- Customer — The company or organization that has an approved account and subscribes to the Service.
- Authorized Users — Employees, supervisors, and administrators designated by the Customer to access the Service.
3. The Service
Construction-Time provides a cloud-based time tracking and workforce management platform designed for subcontractor crews and construction job sites.
The Service includes crew clock-in/out, time tracking, job-based reporting, and administrative tools as described in the Customer's selected plan.
4. Accounts and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must ensure that Authorized Users comply with these Terms and your acceptable use policies.
5. Acceptable Use
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. You must not attempt to gain unauthorized access to any part of the Service or other customers’ data.
6. Subscriptions, Billing, and Renewal
- Subscriptions are billed on a recurring monthly basis.
- A one-time onboarding fee may apply when a new account is activated.
- Accounts are approved before billing starts. No charges are applied until your account has been reviewed and approved by Construction-Time.
- Upgrades or downgrades take effect at the start of the next billing cycle unless otherwise agreed in writing.
- If payment fails, we may suspend your account after repeated failed payment attempts. We will notify you before suspension.
- Fees are non-refundable except where required by law.
7. Data and Privacy
You own all data you submit to the Service. Construction-Time takes reasonable administrative and technical measures to protect customer data. We process data in accordance with our Privacy Policy. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.
8. Availability, Changes, and Maintenance
We strive to keep the Service available but do not guarantee uninterrupted access. We may perform scheduled maintenance and will notify you when reasonably possible. We may modify the Service or these Terms; material changes will be communicated in advance.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE TOTAL FEES PAID BY THE CUSTOMER TO CONSTRUCTION-TIME IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE EXCLUDE LIABILITY FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO THE EXTENT ALLOWED BY LAW.
11. Indemnification
You agree to indemnify and hold harmless Construction-Time LLC, its affiliates, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party rights.
12. Termination
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- We may suspend or terminate your account for breach of these Terms or nonpayment.
- Upon termination, you may export your data during a reasonable retention period. We will provide details upon request.
13. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Florida.
